Title: Computer Software Copyrights

Purpose
It is the intent of Upper Moreland School District to adhere to the provisions of copyright laws in the area of computer software.

Authority
The Superintendent or designee will assure that the supervisor of each site shall be responsible for establishing practices which will enforce this policy.

Procedures
In an effort to discourage violation of copyright laws and as a sincere effort to operate legally, the School District resolves that:

  1. All employees of the School District will receive a copy of this document and will be expected to adhere to the relevant law and provisions of Public Law 96-517, Section 7 (b) which amends Section 117 of Title 17 of United States Code to allow the making of a back-up copy of computer programs provided:
  2. Illegal copies of copyrighted programs will not be made or used on Upper Moreland School District equipment.
  3. Copies of software (including downloaded software, including those downloaded via the Internet) other than "public domain" software, cannot be made without the permission of the vendor or copyright owner, except as stated in paragraph 5.
  4. An extensive attempt will be made by the Upper Moreland School        District to research and recommend acceptable alternatives to software copying including:
    a. establishing individual licensing agreements with software publishers allowing legal multiple copies
    b. the use of networking or disk-sharing systems
    c. purchase of software site licenses “volume licensing”
    d. establishment of software preview policy
    e. exploration of cooperative or bulk purchasing agreements
  5. A computer program may be legally copied only as permitted by law and/or according to the program’s terms and conditions or contractually agreed to terms and conditions, in order to maintain archival, backup or additional copies for use.
  6. Backup or archival copies may not be used simultaneously with the original program.
  7. Duplicating copyrighted software to any digital media for use as an additional copy is illegal.
  8. The School District will provide for software expenditures as a budgetary item. Priority will be given to software which supports and/or is critical to curriculum or operating needs.All other software will be purchased if reasonable need is established and/or financial resources allow for such purchase.
