Title: Construction Contracts Subject to Bid

Purpose:
It is the policy of the Board to obtain competitive bids for construction, repairs and maintenance where such bids are required by law or where such bids may be believed to bring about a cost saving to the school district.

Authority:
All construction, repairs and maintenance of any nature, unless exempt by statute, having an aggregate cost of $10,000 shall be subject to competitive bidding after advertisement as required by the School Code, except where the entire cost is less than $5,000 and performed by District personnel. For work up to $10,000, advertisement is not required if bids from at least three responsible bidders are solicited.

Responsibility:
Bid specifications shall be prepared by the Secretary or Superintendent.Bid specifications shall provide for alternates wherever possible.The Secretary is authorized to advertise for bids in accordance with statutory procedures without prior approval of the Board, but shall inform the Board of such action at the meeting next following. Records shall be kept in sufficient detail to show that a reasonable number of qualified vendors were invited to bid.Bids shall be opened publicly by the Secretary or Superintendent before one or more witnesses at a previously designated time and place. Contracts shall be awarded to the lowest responsible bidder, kind, quality and material being equal, upon resolution of the Board, unless the Board chooses to reject all bids.The Board recognizes that emergencies may occur when imminent danger exists to persons or property or the continuance of existing school classes is threatened, and the requirement for advertised bidding cannot be met because of the need for immediate action.Whenever a contractor shall submit a bid for the performance of work and the contractor later claims a mistake, error or omission in preparing said bid, the contractor may withdraw its bid as permitted by law.
