Title:

Student Residency

Purpose

 The Board shall operate the schools of this district for the benefit of children residing in this district and eligible for attendance.  To be eligible, children must be of school age and satisfy all other legal requirements which may be relevant.  Eligible children who are residents according to the terms of this policy may receive a free public education from the district.
 Children living in institutions located in the district will be permitted to attend district schools, as required by law and as set forth in this policy, with tuition as permitted by law.

The Board may permit the admission of non-resident students only as set forth in this policy.

Delegation of Responsibility
The Superintendent or designee shall develop procedures for the enrollment of all children consistent with this policy.

                 1. The Upper Moreland School District will permit a child to attend its schools as a resident if the child is:

                                 (a)        an unemancipated child whose parent or court-appointed guardian is a legal resident of
                                             the district
                                 (b)        an emancipated child who resides in the district
                                 (c)        a child supported gratis by a resident of the district in the resident's home full-time
                                             (and not just for the school year), as if the child were the resident's own
                                 (d)        a child placed in the home of a resident of the district by order of a court or agency, or
                                 (e)                a child who is a bona fide foreign exchange student under a national or international
                                             program of a responsible organization engaged in an exchange student enterprise
                                             in cooperation with the United States government through its regulatory agencies,
                                             living with a resident of the district, on application of that resident.

                2. The School Board reserves the right to investigate and verify the residency of any student and to
                   require a sworn statement of residential support for the student who resides with a person other
                  than a parent, guardian, or custodian.  Proof of residency and/or support rests with the person
                  making the application for admission.

Residency:

 Residency is established at the time of registration and verified by presentation of the following:

·        Agreement of Sale/Lease                

·        Property Deed

·        A Mortgage Agreement

Plus one of the following Proofs of Residency:

·        Internal Revenue Statement

·        Driver’s License

·        Bank Statement

·        Current Utility or Cable Television Bill bearing new address

If any of the above written evidence is unavailable, residency may be confirmed by the Superintendent or designee through a visit to the home and/or confirmation with a rental or real estate agent.

In the event of a parental separation or divorce with undetermined custody, the child shall be entitled to free public school education in the school district of the parent with whom the child resides.  When sole custody is formally awarded, a copy of the court order must be in the school the child attends.  Education of the child becomes the responsibility of the school district of the parent who has custody.

Multiple Occupancy:

·        If a parent or legal guardian, residing within the boundaries of the Upper Moreland School District is not the owner or lessee of the residence in which they live; Multiple Occupancy Forms are required at the time of registration.

·        Multiple Occupancy Forms are obtained from the Child Accounting Office and the completed forms are returned at the time of registration.  The Child Accounting Office shall send a copy of the completed forms to the building where the child(ren) will attend, to be maintained on file.

·        Married students living in parents' home shall complete Multiple Occupancy Forms.

Affidavit:

Before admitting a child supported gratis by a resident of the district in the resident's home full-time
            (and not just for the school year), as if the child were the resident's own, the district shall require the
            resident to file a sworn affidavit of responsibility with the secretary of the Board.  

That sworn statement must state the affiant is a resident of the district, that he or she is supporting the child gratis, that the child will be listed as a dependent on the affiant’s Federal Tax Return for the year in question, that the affiant will assume all personal obligations for the child relative to school requirements, and that he or she intends to so keep and support the child continuously and not merely through the school term.

On or before April 15th of the school year, the affiant shall provide a photocopy of the year’s tax return, listing the dependent child on his or her tax return.  Failure to do so will result in the issuance of a tuition bill for the school year to date, and the immediate transfer of the child to his or her parent or guardian’s home school district. 

The affidavit of responsibility process must be completed on a yearly basis for any child who is to be
supported gratis by a resident of the district in multiple years.

The district may require documentation from the child’s parent or guardian as to why the child is unable
            to reside with them. 

Court-Ordered:

If documentation of placement of a child in the home of a district resident by order of the court or arrangement with an agency is not available at the time of registration, assessment and confirmation by the Child Accounting Office, in conjunction with the court, agency, or institution making placement, will provide proof of residency for purposes of education of the child in the Upper Moreland School District.

When students in special education classes transfer from one school district to another, the processing involved can cause significant delays in enrollment.  In order to prevent delays, the residency should be confirmed prior to moving into the Upper Moreland School District.  The Child Accounting Office and the Director of Special Education and Support Services will work cooperatively to assemble the needed records for processing.           

Children in Institutions

Non-resident children in institutions for the care and training of children, which institutions are located within the district, shall be admitted to attend district schools as required by law, with tuition charges as permitted by law. 

Non-Resident Students

Non-resident students may apply for admission to district schools, with or without payment of tuition.

The Superintendent or designee shall develop procedures for the collection of information to present to the school board.    

The School Board will permit a twenty (20) school day grace period, tuition-free, for non-resident students whose family is moving into the school district or whose family is moving from the school district only under the following conditions:

1.         Incoming families

(a)        That the family becomes residents of the school district on or before the twentieth  (20) school day from the first day of school, and

(b)        That the parent or legal guardian provides transportation for the non-resident student during the grace period

2.         Outgoing families

(a)        That the family moves from the school district during the last twenty (20) school days classes are in session for the school year, or,

(b)        That the family temporarily moves from the school district during the school year, and then moves back into the district within twenty (20) school days, and

(c)        That in either of items a or b, the parent or legal guardian provides transportation for the non-resident student

Parents/guardians of students that have successfully completed their entire freshman, sophomore, and junior years at Upper Moreland High School may submit a written request to the Board for them to consider granting permission for a student to complete his or her senior year at the high school.  Any approval would be contingent upon parental agreement to provide all necessary transportation, pay the appropriate tuition charges, and meet all requirements expected of other students.  For the student to be assured that he or she can begin the senior year on the first day of school, the written request must be received by the Board Secretary in the District Office on or before the final workday in July. 

Except as set forth in sections one (1) and two (2) (Incoming and Outgoing Families), admission of non-resident students shall be upon payment of tuition.  Tuition shall be paid quarterly in advance of the billing period for all scheduled school days.
